Terms of Use — Der Die DaZ

These Terms of Use (“Terms”) govern your use of the Der Die DaZ mobile application (the “App”), provided by Renato Stauffer, Hegibachstrasse 68, 8032 Zürich, Switzerland (“we”, “us”). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

The App is also subject to Apple’s Licensed Application End User License Agreement (EULA), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. Where these Terms and Apple’s standard EULA conflict, Apple’s standard EULA governs the licensed-application terms, and these Terms supplement it.


1. Licence

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the App for your own non-commercial German-language learning, in accordance with these Terms and Apple’s EULA. You may not copy, modify, reverse-engineer, resell, or redistribute the App except as permitted by law.

2. The service

The App helps you learn German (levels A1–B2) through lessons, reviews, and assignments. Core functionality is available for free. A paid upgrade (“Pro”) unlocks all levels and additional content.

The App stores your learning data on your device and syncs it to your own iCloud account. Your use of iCloud is governed by your agreement with Apple. See our Privacy Policy for details on data handling.

3. Purchases and subscriptions

The App offers the following in-app purchases, sold and billed by Apple through the App Store:

Prices are set in the App Store and may vary by region and change over time; the price shown at the point of purchase is authoritative.

Auto-renewing subscriptions

By purchasing an auto-renewing subscription, you agree to the following:

Refunds

Purchases are processed by Apple, and refunds are handled by Apple under Apple’s policies. Requests can be made via https://reportaproblem.apple.com. We do not process payments and cannot issue refunds directly.

4. Acceptable use

You agree not to use the App unlawfully, to interfere with its operation, or to attempt to circumvent purchase or content gating.

5. Intellectual property

The App, its content, and its learning materials are owned by us or our licensors and are protected by law. These Terms grant you no rights in that content except the licence in Section 1.

6. Disclaimer of warranties

The App is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the App will be uninterrupted, error-free, or that learning outcomes will be achieved. Syncing depends on Apple’s iCloud service, which we do not control.

7. Limitation of liability

To the fullest extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data arising from your use of the App. Nothing in these Terms limits liability that cannot be limited by law (including, for consumers, mandatory statutory rights and liability for death, personal injury, or gross negligence/intent). Statutory consumer rights are not affected by these Terms.

8. Changes

We may update the App and these Terms. Material changes to these Terms will be reflected in an updated version at this URL, with a revised “Last updated” date. Continued use after changes take effect constitutes acceptance.

9. Termination

You may stop using the App at any time and delete it. We may suspend or terminate the licence if you materially breach these Terms.

10. Governing law

These Terms are governed by the laws of Switzerland, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods (CISG), and without prejudice to mandatory consumer-protection rules of your country of residence. The courts of Zürich, Switzerland have jurisdiction, subject to any mandatory consumer jurisdiction rules.
